Dear Mr President

The Humanistisch-Vrijzinnige Vereniging (HVV), which unites Flemish humanists and freethinkers, wishes to add its protests to those of the Polish Section of the International Commission of Jurists, IUSTITIA the Polish Judges Association, the Helsinki Foundation for Human Rights, Human Rights Watch and many others against several recent developments for which your Government is responsible.

We are particularly concerned at the persecution of homosexual people, with extreme right-wing gangs going unpunished for attacks on demonstrations in favour of tolerance, and in particular the announcement on television on April 25 by the Vice-Minister of Education that his ministry is working on a draft law that will forbid homosexuals being employed in schools. We wish to remind you that Article 13 of the Amsterdam Treaty spells out clearly that the forms of discrimination which are not to be tolerated within EU member states include “sex, racial or ethnic religion or belief, disability, age or sexual orientation”. In addition, the EU Council Directive 2000/78/EC, which establishes a general framework for employment and occupation, provides specific protection for employees against discrimination due to their sexual orientation.

Your persistence with this policy to entrench in law discrimination against homosexual people could ultimately require expulsion of Poland from the European Union.

We are also deeply concerned about:

(a) the excessive action you are taking against persons suspected of even minimal cooperation with the former communist government, which was never illegal and often done with reluctance under compulsion. The requirement for all senior civil servants, university professors, lawyers, headmasters and journalists born before 1972 to answer the question: Did you secretly and knowingly collaborate with the former Communist security services? This violates basic democratic norms provided for in the European Convention, Polish constitution, and other treaties;

(b) the new Law on Foundations, which threatens the independence of non-government organisations and allows government to interfere and even close down organisations whose activity the Government does not like;

(c) intemperate criticism by Government ministers of the Constitutional Court and other courts, threatening to undermine the independence of the courts;

(d) criticism by the Minister for Education of the teaching of evolution, a basic element of established science.

We believe that some of these actions are clear breaches of the European Convention on Human Rights and, if not corrected, will ultimately threaten the adherence of Poland to the Council of Europe.

We urge you urgently to reverse these policies.

Yours sincerely,

Prof. Dr. Rik Pinxten
Chairman HVV
